- a) Water ingress was noted to the front bay window and also around the chimney breast in the second reception room. b) Condensation was noted at several points around the Property. Whilst some of this may occur due to lifestyle, this was not helped by the lack of ventilation within the Property particularly in the bathroom which did not appear to have a functioning extractor fan. c) Due to the above, the condition of the bathroom was extremely poor. d) Broken stair treads were noted which potentially could be dangerous. e) The rear garden fencing to the right-hand elevation had collapsed rendering the garden virtually incapable of beneficial use. f) The Tenants reported that [omitted] one of the Landlord’s contractors had stated that there was no insulation to the roof space above the third bedroom. g) The Tenants noted water ingress around some of the double-glazed window units. 17. During a single limited inspection on a relatively dry day, it was difficult for the Tribunal to form any view in respect of items f) and g) above. However, the other issues were identified during the inspection and in the opinion of the Tribunal require a rental adjustment to compensate for the same. As regard the condition of the Property the Tenant stated that the shower is not leaking and they do not have a shower and must be a mistake on the part of the Landlord. There are however other outstanding repairs including: Damp and mould and repainting required. 19. In conclusion the Tenant therefore considers the Landlords rental value of the Property is not justified. The Landlord 20. The Landlord submitted details of the following comparable evidence from within the same building: Flat B - £1000 pcm Flat 16A - £950pcm Flat 14 - £900 pcm 21. All three properties are broadly similar in size, layout and internal specification. 22. In addition, the Landlord submitted a Best Price Guide Report setting out further comparable properties from the surrounding area supporting the above figures. 23. The Landlord stated that all repairs have been carried out and the only outstanding matter is a leaking shower which has been scheduled. 24. The new rent takes effect from the date specified in the Landlord’s Notice of Increase unless that would cause undue hardship to the tenant. In cases of undue hardship, the Tribunal has a discretion to fix a later starting date up to the date a Tribunal makes its determination. 13. The Tenant has stated in her application that the increase proposed would place an undue financial burden on her. She has not specifically asked the Tribunal to fix a later starting date in this case. However, the Tribunal has considered the matter and determined that it will not fix a later starting date for the new rent in this case.
