- two bedrooms, lounge, kitchen, bathroom The property has central heating and double glazing. The Property is situated in a purpose built block. Evidence 12. The Tenant made the following comments: a) The Tenant states that they think the market rent of the property is £625 because of the lack of maintenance by the Landlord for the 27 years of the tenancy. b) In support of the application, the Tenant provided photographs of the subject property. 13. The Landlord responded: a) She has carried out all necessary works to the property, including upgrading the bathroom, replacing the boiler, front door and side windows, and the cooker. b) The proposed rent is £200 pcm below rents charged locally. The Landlord had always tried to keep the rent low, and set the rent increase below the market level because of the Tenant’s situation. c) The rent has only been increased three times in 27 years. d) The condition of the ceiling, windows and walls has been caused by the Tenant smoking in the flat. e) The Landlord provided comparables, of two bedroom properties from £1,100-1050, and of one bedroom properties where the advertised rents were between £875-925. 14. The Tenant replied a) Only the sink and toilet were replaced in the bathroom. b) A new boiler had only been supplied following successive repairs to the previous boiler. c) The front door was replaced following a Council requirement. d) The side windows were replaced by the Council. e) The council replaced the roof but the Landlord failed to maintain the guttering causing a damp patch in the kitchen window. f) The Landlord replaced the faulty cooker but ripped the Tenant’s lino. g) The Tenant has decorated the property three times. h) Three further photographs were supplied. 15. The Landlord replied by email a) The walls in the bathroom were also re-tiled and the shower replaced. b) The front door and two sidelights were replaced as instructed by the Council. c) The Landlord had agreed to replace the lino but the Tenant had replaced it herself. d) The guttering had been the responsibility of the Council, which had done the maintenance on her request.HAV/00HY/MRA/2026/0016 · 2026

- Lounge/bedroom, kitchen, bathroom The property has electric heaters and double glazing The Property is situated in a four storey block constructed in or around the 1970s. Evidence 11. The Tenant made the following comments: a) The Tenant states that the following “improvements” have been done by them to the property: changed carpets, replaced curtains, and replaced the washing machine with a washer-dryer. b) c) d) The Tenant states that they think the market rent of the property is £925. The Tenant asked the Tribunal to consider that the property is between the police station and the hospital and, as a result, next to one of the busiest junctions in Brighton with up to 100 emergency vehicles going past throughout the day. The Tenant provided suggested comparables where the rents were between £800-£925 pcm. 12. The Landlord responded: a) The property has a gross internal area of 29 square metres, which is in the EPC (which has a D rating). b) The Tenant’s improvements had not been requested from the Landlord, and so they should be disregarded. c) The Landlord provided a tenancy agreement in relation to the following other properties: At 9 Stafford Court where the rent was £990 pcm, commencing on 24th March 2025. The Tribunal notes that it is said to be a “fully managed” agreement. The Landlord has provided the EPC for that flat, which was rated a C and is 29 square metres. 3 At Flat 7, Stafford Court where the rent was £990 pcm, commencing on 15th August 2025. The Landlord has provided the EPC for that flat, which was rated a D and is 30 square metres. At 14 Stafford Court where the rent was £980 pcm, commencing on 29th May 2026. The Landlord has provided the EPC for that flat, which was rated an E and is 28 square metres. At 1 Stafford Court, where the rent was £980, commencing on 27th June 2026. The Landlord has provided the EPC for that flat, which was rated a D and is 27 square metres. d) The Landlord’s commentary was to the effect that she was seeking to bring the rents of all the similar properties in the building into line, taking into account their positioning and their appeal to the market. e) Other documents provided by the Landlord included fuller particulars of the properties offered by the Tenant as comparables. Those properties were said by the Landlord to be in a different area. f) The landlord provided photographs of the state and condition of theHAV/00ML/MNR/2026/0168 · 2026
- two bedrooms, kitchen, living room, Bathroom The property has central heating. The Property is situated in two storey building with on street parking Evidence 13. The Tenant made the following comments: a) The Tenant states that they think the market rent of the property is £1450 because of defects to the property, including mould, structural noise, insecure windows, poor insulation; poor state and condition of the property currently; and poor maintenance. b) Those issues were adumbrated in a detailed statement which included details of issues when the Tenant moved in to the property, as well as the current state of disrepair following £9000 building works, including: mould and damp throughout the property; failed window seals; structural noise nuisance due to roof slates; poor insulation. c) The property is “far from premium”. d) Evidence of emails to the Landlord’s agent detailing repair issues over the course of the tenancy was provided. e) Comparables of properties in the BN1 area were provided, including the neighbour’s property, between £1350-1550pcm. The neighbour’s property with a garden had let for £1300pcm. 14. The Landlord’s agent responded: a) The property was handed over in an exemplary condition, and provided the inventory. b) The property is a premium multi-storey maisonette, finished to a high architectural standard with premium fixtures. c) The Landlord has a proactive maintenance regime. d) Degradation of the internal aspects of the property are a result of tenant lifestyle and a breach of the tenancy agreement, rather than landlord neglect. “Lifestyle choices” have caused inadequate ventilation and condensation. e) The Tenants have blocked access to tradespeople. f) The Landlord has consistently authorized significant capital expenditure to resolve day-to-day wear and tear. g) The property is in an exceptional commuter location. h) The Tenant made a counteroffer of rent at £1600 pcm, and the Landlord would accept £1650. i) The Landlord requested various orders which, the Tribunal observes, are beyond the scope of this determination. 15. The Tenant replied a) The Landlord’s assertion that the property was in an exemplary condition at the outset is rebutted by the evidence. b) The property does not have premium fixtures and specification. c) The energy loss report – EPC which placed the property in Band D -indicates poor insulation in the loft. The Property is situated in a rural location is a relatively modern type of workman’s cottage. Evidence 11. The Tenant made the following comments: a) The Tenant states that the following “improvements” have been done by them to the property: attic insulation, carpet in the living room, painting walls, cleaning gutters, window frame and hinges repair. b) The Tenant states that they think the market rent of the property is £1100. c) The property has very old storage heaters, poor insulation/windows, no floor insulation and there are ongoing damp issues. It has an energy rating of E. It costs a considerable amount to heat during winter and only reaches temperatures of 16 degrees. 12. The Landlord responded: a) The tenancy agreement was with the Tenant and a third party. b) The Tenant’s comments about the kitchen, repairs and improvements had not been reported to the Landlord, who is willing to inspect and address genuine issues. c) The Landlord informed the Tribunal that it had evidence of comparators in rural and semi-rural locations locally of similar properties at rents between £1400-1800. The Tribunal notes that details of those comparisons were not provided to it by the Landlord. 13. The Tenant replied: a) The other named Tenant left the property seven years ago. The Landlord was aware of that departure and did not request any change to the tenancy agreement. b) The Tenant had a co-operative relationship with the Landlord, with whom she corresponded either by text message or telephone call. The Landlord had always conducted minor repairs expeditiously. c) The Landlord’s agent had not followed up the Tenant’s emails or a request to inspect the property. d) The Tenant had accepted the property at the outset in basic condition and the overall standard remains unchanged. Only minor decoration has been conducted, including attic insulation. e) The windows are ageing and have failed seals causing condensation and misting between the panes. f) There is damp affecting the bedrooms g) There is poor insulation to the roof and the floors. h) There are concerns regarding the condition of the roof and the fixtures and fittings are generally dated. i) The Landlord’s comparators have been modernised and are a higher standard. j) The tenancy agreement provides that, "The Landlord can increase the rent every twelve months on the date on which the tenancy began. - the landlord is required to carry out those repairs to the property the liability for which is imposed upon the landlord by section 11 of the Landlord and Tenant Act 1985 (‘the 1985 Act’); and to put and keep the property in a state fit for habitation as required by section 9A of the 1985 Act. 9. Maintain appliances: the landlord is required to put and keep in repair and proper working order the central heating system, electrical appliances and other equipment provided by the landlord for the use of the tenants. Services or furniture provided by Landlord (other than carpets and curtains and white goods specified below) and the costs relating to the same. 10. Mr Hendry has confirmed that whereas furniture is provided under the tenancy (for which he says a full inventory is provided), there are no services. Liability for Council Tax 11. The tenants are responsible for the payment of Council Tax in respect of the Property. The rent determined is exclusive of Council Tax. Any other terms of the tenancy taken into consideration in determining the rent. 12. The tenancy is for a term of six months with a commencement date of 14 August 2025. Accordingly, to follow section 14(1)(b) of the 1988 Act, the rent at which the Tribunal is to determine the rent in this application is as specified in the notice - 14 February 2026. 13. The tenants are required to maintain the garden and grounds (to include any terrace or patio) and to keep the grass cut and reasonably maintain any lawns, trees and shrubs etc. Inspection/Hearing 14. Neither party requested an oral hearing. The Tribunal has considered this case on the bases of the papers provided by the parties, having viewed the property on the internet and its own knowledge and specialist expertise. The Property 15. 1 Holywell Close is a detached two-storey house of traditional brick construction with a pitched tiled roof. From the descriptions given by the parties and the floor plan provided the accommodation comprises: Ground floor - entrance hall, cloakroom/WC, reception room, kitchen/diner with utility room off. Stairs in the entrance hall up to… First floor – bedroom one with shower room/WC en suite, bedroom two, bedroom three and bathroom/WC. Outside – garage, off-street parking and private garden. From the information provided the garage has been sub divided into two. The parties have provided the Tribunal with various photographs of the property, both internal and external. In addition, the Tribunal has been provided with a copy of the Inventory Report of the property dated 13 August 2025. The report includes both internal and external photographs too. The photographs show the items within the inventory included in the tenancy. Holywell Close is in the southern part of Swanmore and is accessed off Hill Pound and Horders View. Evidence 16. Ms Thomas on behalf of the landlord has submitted a Statement which includes various photographs to assist to present her case. Mr Hendry has submitted a Statement on behalf of the tenants which includes various photographs too. Mr Hendry had provided further evidence in the tenants’ form Rents 1 (their application) coupled with an evidence bundle and a joint tenant information sheet. The Tenants. 17. Under ‘other facilities’ in their application Mr Hendry says there is: a small garden, a garage which is sub-divided in two with the rear section available as storage area and front main door section not accessible, and an outdoor hot tub for which ongoing maintenance is not provided by the landlord. 18. Under ‘Improvements’ Mr Hendry says the tenants have installed full-fibre broadband (1Gb capable) with the landlord’s consent. 19. In his covering email to his Statement, Mr Hendry informs the Tribunal he has commented on Ms Thomas’ submissions on behalf of the landlord and refers to his evidence previously submitted with the tenants’ application. 20. Mr Hendry confirms the accommodation at the property and as outlined in paragraph 15 above. Mr Hendry includes photographs to show: a) Location of heating control – not fully fixed. b) Landlord’s bedding and other bits. c) Part furnished nature – mattress only. d) Garden LED lighting and solar panels (no indication of benefit). e) Garage – stated as home office, only suitable as a store and front section inaccessible. f) Single air conditioning unit on the first-floor landing. 21. Under ‘Features’ Mr Hendry confirms those set out by Ms Thomas, save there is no garage and the air conditioning is limited to the unit on the first-floor landing. 22. Under ‘Improvements’, Mr Hendry accepts the kitchen and bathroom equipment are of modern appearance, reaffirms the limited air conditioning and with respect to the solar panels (an 8Kw system) says as the tenants have no access to any associated data, they are unable to confirm any benefit derived there from. 23. Under ‘Disrepairs/Defects’, Mr Hendry lists various items, of which the Tribunal notes some had been rectified at the date of the Statement, 28 February 2026, others remain outstanding. 24. Under ‘Any Other Comments’ Mr Hendry lists the following, in outline: a) The property comprises three bedrooms only, the garage has been sub-divided, of which the accessible rear section is unheated and used for storage only. b) The property is part furnished only. c) WiFi was not included in the tenancy agreement. The Nest heating control, the Ring alarm and doorbell systems were not activated for the tenants use. d) The hot tub is not serviced by the landlord, and the tenancy agreement provides that maintenance thereof is the tenants’ responsibility. e) The nearest railway stations are Botley and Fareham, approximately five miles and nine miles distant respectively. The property is therefore reliant on road transport. 25. Mr Hendry concludes to say, ‘Having regard to the size, three-bedroom configuration, partial garage access, part furnished status, and comparable three-bedroom properties in Swanmore and nearby Bishop’s Waltham currently marketed between £1,550 and £2,000 per calendar month, the tenant assesses the market rent at £1,950 per calendar month.’ Comparable lettings’ evidence 26. Mr Hendry has provided the Tribunal with comparable rental evidence to assist the Tribunal which includes listings and corresponding lettings’ particulars with photographs, floor plans and location maps. 27. Mr Hendry says the comparable listings reflect the local rental market within approximately a three to five miles radius and include properties of similar or higher specification. Mr Hendry summarises the listings as follows: a) Comparable three-bedroom houses are generally advertised and let in the range of approximately £1,650 to £1,975 per calendar month, to include non-estate and recently let properties. b) Purpose-built rental developments offering newer accommodation with additional amenities and on-site management are available at around £1,870 to £1,875 per calendar month. c) Larger four-bedroom detached houses, including newer and non-estate properties, are available in the range of approximately £1,995 to £2,100 per calendar month. d) These comparables indicate the proposed rent of £2,150 per calendar month sits above the prevailing market level for a standard three-bedroom estate property of this type and condition. e) Under any other information, Mr Hendry says at the time the section 13 notice was served the property was not fully functional due to unresolved maintenance issues. The following are listed: no effective heating in bedroom one and the landlord’s dishwasher was inoperable. Mr Hendry goes on to say steps have since been taken to address these matters, they remained outstanding at the relevant date and are therefore relevant to the assessment of the reasonable market rent. On behalf of the Landlord, Ms Gemma Thomas of Bernards Estate Agents has given a Statement. 28. In her Statement, Ms Thomas has included photographs of the property to assist to present her case, a floor plan, a copy of the tenancy agreement, a copy of the inventory report and a Best Price Guide of the comparable lettings’ evidence to which she has referred to assist the Tribunal. 29. Ms Thomas confirms the property’s accommodation to be that as described in paragraph 15 above. Under ‘Features’, Ms Thomas says central heating, double glazing, carpets and curtains, the White Goods to include a wine cooler, a garage, off-street parking and private gardens are all provided by the landlord at the property. 30. Under ‘Improvements’, Ms Thomas outlines the following: a) The landlord renovated the property and converted the garage to a home office. b) Fully serviced hot tub and large 8Kwp solar panels. c) An air conditioning unit was fitted. 31. Under ‘Service Charges’, Ms Thomas says high speed internet is included in the rental agreement and goes on to say this is at a higher cost due to the security system in place at the property as well. 32. Under ‘Disrepairs/Defects, Ms Thomas says: the property is all in a good order throughout, an inventory is included, the bathroom and kitchen are five years old, the property benefits from a hot tub, air conditioning and solar panels. 33. Under ‘Any Other Comments’ Ms Thomas says the property is situated in an area with both bus and rail transport links, with well rated schools. The area is such that when properties come on to the rental market, a let is agreed quickly. 34. Under ‘Your assessment of the rental value of the property’ Ms Thomas refers to four comparable properties in a Best Price Guide for properties marketed to let from February 2024 to February 2026. Briefly each is described as follows: a) A four-bedroom detached house on Chapel Road, Swanmore, marketed to let in September/October 2025 at £3,500 per calendar month. b) A four-bedroom detached house on Horders View, Swanmore, marketed to let in May 2025 at £2,500 per calendar month. c) A four-bedroom detached house on Spring Lane, Swanmore, marketed to let in May/June 2025 at £2,100 per calendar month. d) The subject property, a three-bedroom detached house, marketed to let in July/August 2025 at £2,000 per calendar month. 35. Ms Thomas adds that the property is offered furnished. There are no current advertised properties in this area as it is desirable with the local schools. Ms Thomas says she has extended her search back two years and includes four-bedroom houses, unfurnished, with no modernisation. Ms Thomas concludes to say, in effect, the benefit of the fourth bedroom is offset against the subject property’s air conditioning, the home office, the solar panels and the WiFi.HAV/24UP/MNR/2026/0014 · 2026

Parking is by way of on street parking with a residents’ permit. The Property is situated in a residential area in the centre of Ashford with good transport links. Evidence 11. The Tenant made the following comments: a) The Tenant states that the gas boiler has stopped working on several occasions, and there has been extensive mould on the second bedroom wall and around the bath for around six months. b) The Tenant states that they think the market rent of the property is £1300 based on comparables compiled from the date of service of the notice to early May 2026. 12. The Landlord’s agent responded: a) The property is a good sized, desirable three bedroom house in the centre of Ashford, benefiting from proximity to the railway links. b) The Landlord is proactive with repairs, which have been completed within a reasonable time from the date of notice, and the property is in good condition. c) Contractors have frequently advised that arranging access to the property has been challenging d) A report was enclosed with comparables of rents which had recently been achieved. Rental values in Ashford were said to have continued to increase during 2026. 13. The Tenant replied: a) Of the 28 properties supplied by the Landlord’s agent as comparables, 14 were duplicates. Of the 14, 13 were superior in terms of property type and amenities. The remaining property was advertised at £1,450 but the Landlord’s agent has reduced it to £1,350. b) The market analysis documents provided by the Landlord’s agent suggests that the average prices have remained the same or decreased over the past 12 months.HAV/29UB/MNR/2026/0169 · 2026

It benefits from central heating and double glazing, air-source heating with a car parking space. The Property is situated in Dartford on an estate built predominantly for renting. The property was designed as a “Palm” format. Evidence 11. The Tenants completed the relevant MR1. The Landlord replied using Form 1A. The Tenants responded to the Landlord’s reply. The Tenants 12. The Tenant made the following comments: a) The proposed increase appears high in the current economic climate. b) Higher rental levels are contributing to a rise in vacant properties. c) Others have raised similar concerns over rent rises. d) An identical property next door was being advertised for £2275. e) They proposed a rent increase of £50 per month. f) There have been repairing issues at the property which affect the property’s condition and overall enjoyment. Photographs of such repairs and a commentary on the Landlord’s repairing record were provided in their response. The commentary indicated that certain repairs remained outstanding, including but not limited to the patio door and following water ingress. 13. The Tenants provided a range of comparables, drawn from RightMove and other websites, including for the next door property. The range of rents for these properties was from £1800 - £2300. Their reply to the Landlord’s comparables included properties from £1650 - £2375. The Landlord 14. The Landlord asserted that the most recent lease renewals prior to 1st May 2026 for properties of the same type (ie “Palm”) had achieved the following rents: a) Stone Lodge Road - February 2026 - £2,425pcm b) Heathcote Street - December 2025 - £2,400pcm c) Heathcote Street - October 2025 - £2,415pcm d) Stone Lodge Road - October 2025 - £2,415pcm e) Heathcote Street - August 2025 - £2,400pcm 15. They provided a repair record for the subject Property. 16.
