“There are circumstances in which it is permissible to obtain early disclosure after the commencement of proceedings but before close of pleadings. The court always has the power so to order, but such orders are rare. For an early disclosure application to be successful, specific documents relevant to the action must be targeted, and the applicant must be able to show that it is not in a position to plead its case without access to those documents. There is, however, a general right to inspect documents mentioned in pleadings and evidence underCPR rule 31.14 .”
