"In this case I think that the time scale is important. What I am going to do first is to say that I think that the covenant was binding on both defendants. It is quite clear that that was not just a simple agreement on the 2 nd May 1997 but was a schedule to an order of the court if one party felt that the other had not fulfilled a term of a court order, then the course of action is to enforce it through the court. It is not a question of saying: "
