“There is no dispute that … confirming or denying that the information is held would indicate whether Executive Authority had in fact been used during the time specified. If the Appellant holds information of the “outcome of the operation”, that can only be because there must have been an operation (which within the terms of the request would include the use of Executive Authority). The Tribunal is satisfied that s 31(3) FOIA is engaged because confirming or denying that the information is held would indicate whether Executive Authority had been used and the Tribunal is satisfied for the reasons set out above that this would prejudice the prevention and detection of misconduct.”
