"At the hearing, the representative of the defendants in the main proceedings emphasised the economic value of the contract between the contracting authority YTV and Liikenne, and submitted that this was a significant intangible asset. "56 The next element is transfer of staff. According to the first respondents this is a labour intensive sector but there has been no transfer of staff. On the face of it, this is a serious blow to the first respondent's own case. However, we cannot take this fact at face value. This involves us deciding why no staff have been taken on. 57 The explanation, in part, is the decision by Compaq not to do so, to try to ensure that there was no transfer.
