“In these Regulations, unless the context otherwise requires – “employer” except in Regulation 3(2) and (3) includes a person to whom the requirements imposed by these regulations apply by virtue of Regulation 3(3)(a) and (b).”
“For the purposes of this Directive, the following terms shall have the following meanings: (a) worker: any person employed by an employer, including trainee and apprentices but excluding domestic servants; (b) employer: any natural or legal person who has an employment relationship with the worker and has responsibility for the undertaking and/or establishment”

The employer shall take the measures necessary to ensure that the work equipment made available to workers in the undertaking and/or establishment is suitable for the work to be carried out or properly adapted for that purpose and may be used by workers without impairment to their safety and health.”
“(a) to a self-employed person, in respect of work equipment he uses at work; (b) subject to paragraph (5) [which does not apply to the facts of this case], to a person who has control to any extent of – (i) work equipment; (ii) a person at work who uses or supervises or manages the use of work equipment; or (iii) the way in which the work equipment is used at work, and to the extent of his control.”
