“4. ILLEGAL TRANSACTIONS THAT ARE NEITHER CONTRACTS NOR TRUSTS So far, we have concentrated solely on how illegality affects contracts or trusts. However, there is a range of other transactions that may also be tainted in some way by illegality. One example is a ‘gift’ (other than under a trust) … It seems to us that it would be sensible if the discretionary approach which we have provisionally proposed should govern the effect of illegality on contracts and trusts, should also apply to this type of transaction. However, we would be very grateful to receive the views of consultees as to whether this is a practical approach to take and as to what is the range of illegal transactions that are neither contracts nor trusts.”
