JUDGMENT

[1]The claimant’s claim of automatic unfair dismissal is well-founded and succeeds. She was unfairly dismissed.[2]By operation of the principle in Polkey v A E Dayton Service Ltd [1987] UKHL 8, the claimant’s losses are limited to the period 7 January 2020 to 6 June 2020.[3]The claimant contributed to her dismissal by a factor of 25%.[4]The parties agreed that the respondent shall pay the claimant £12,746.22 in compensation for unfair dismissal. Note: This has been a remote hearing. The parties did not object to the case being heard remotely. The form of remote hearing was V - video. It was not practicable to hold a face to face hearing because of the Covid19 pandemic.
