“ 31A Commitments (1) Subsection (2) applies in a case where the OFT has begun an investigation under section 25 but has not made a decision (within the meaning given by section 31(2)). (2) For the purposes of addressing the competition concerns it has identified, the OFT may accept from such person (or persons) concerned as it considers appropriate commitments to take such action (or refrain from taking such action) as it considers appropriate. …”
“4.3 The decision whether to accept binding commitments is at the discretion of the OFT. The OFT is likely to consider it appropriate to accept binding commitments only in cases where: • the competition concerns are readily identifiable • the competition concerns are fully addressed by the commitments offered , and • the proposed commitments are capable of being implemented effectively and, if necessary, within a short period of time”
