“(i) a decision to deport on section 32 grounds must be made before a Deportation Order is made, a decision which is made after a Deportation Order has been signed cannot be a lawful decision; and (ii) in any event, the decision to deport under section 32(5) is contrary to the Article 8 rights of the appellant and his family members.”
“23. The respondent’s decision to deport Mr Greenwood dated24 June 2013 is not in accordance with the law. Given the fundamental nature of the respondent’s error, we remit the matter back to the respondent for the error to be remedied. We, therefore, do not proceed to decide the substance of the article 8 appeal. We allow the appeal against deportation to the afore-mentioned extent only.”
