“As things currently stand, if the Appellants do not comply with the information notices as varied, they will each risk incurring a penalty of£300 plus daily penalties of up to£60 , subject to their success in the Upper Tribunal…. Conversely, however, complying with the notices would render any Upper Tribunal proceedings totally nugatory.”
