"It is the case that, as is common ground between the parties here, the absence of a formal partnership agreement, for example, is not and cannot be definitive of the existence of a partnership. It is also correct to say that it is unnecessary for each partner to take an active role in the running of the business and there is no formal requirement under thePartnership Act 1890 that each partner needs to be identified on the documents emanating from the partnership. All those are trite matters of law."
