JUDGE HARRISCHRIS HUGHESAppellantTHE CHARITY COMMISSIONRespondentDecision: The appeal is struck out under rule 8(3)(a) for non-compliance with a Tribunal direction.REASONS
[1]The Appellant lodged an appeal using the GRC1 form on 29 April 2026. The appeal was incomplete as the Appellant did not include a copy of the decision notice they sought to challenge which gave a right of appeal.[2]By Directions and email dated 30 April 2025the Appellant was required to provide a copy of the Decision Notice that it wished to challenge to the Tribunal within 28 days. The Appellant responded on the same day attaching his submissions, but did not provide a copy of the decision granting appeal rights.[3]By Directions dated 11 May 2026, the Appellant was directed by 26 May 2026 to provide a copy of the Decision Notice granting appeal rights that it wished to challenge to the Tribunal.[4]The Appellant was directed to note that failure to comply with the Direction could lead to the Tribunal striking out the appeal for failure to comply without further direction.[5]The Appellant wrote to the Tribunal by email on 11 May 2026 attaching an email from the Respondent dated 14 April 2026 acknowledging receipt of his concerns and stating that it would not be taking further action. The decision relied upon is not a formal decision which gives a right of appeal.[6]The Appellant failed to comply with the Direction dated 11 May 2026 and accordingly there are grounds to strike out the appeal.
