REASONS
[1]The Appeal is struck out. REASONS The Respondent has applied to have the case struck out under Rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009) on the basis that the appeal has no reasonable prospect of success.[2]The Respondent has stated that the appeal has no prospect of success because the part 1 test has expired, meaning that the Appellant may not, now, re-book the part 3 test.[3]Directions were sent to the Appellant on 14th April 2026. The directions warned that the Tribunal was considering striking out the appeal and required a response by 28th April 2026.[4]No response has been received from the Appellant. I am satisfied that the Appellant has had the opportunity to respond, as is required by Rule 8(4).[5]Under Rule 8(3)(c), the Tribunal may strike out a case where the Tribunal considers there is no reasonable prospect of the Appellant's case, or part of it, succeeding.[6]The test under Rule 8(3)(c) is met and the appeal is therefore struck out.[7]In making this decision I have considered the overriding objective and exercised my discretion under Rule 8(3).
