[1]The Appellant appealed, on 18 November 2025, a decision of the Respondent dated 5 November 2025 refusing their application for a third trainee driving licence.[2]This appeal was referred to me to consider striking it out as pursuant to an application to that effect made by the Respondent, pursuant to Rule 8(3)(c) of the Tribunal Procedure (First-tier Tribunal) (General Regulatory Chamber) Rules 2009 (‘the Rules) on 12 January 2026, copied to the Appellant, as the Appellant, on 9 January 2026, had failed their third attempt to pass their Part 3 test.[3]Regulation 14(b) of the Motor Cars (Driving Instructor) Regulations 2005 provides that a trainee licence remains in force only until the day immediately following the Appellant’s third unsuccessful attempt to pass their Part 3 test.[4]Accordingly, this appeal is struck out as having no reasonable prospect of success, pursuant to Rule 8(3)(c) of the Rules.
