[1]This case concerns an appeal against the Respondent’s decision to refuse the Applicants third trainee licence application.[2]The Applicant lodged a Notice of Appeal dated 17 June 2026 with the Tribunal.[3]The Respondent applied on the 2 July 2026 for the case to be struck out. The strike out application was made on the basis that the Applicant’s application has no prospect of success under Rule 8(3)(c) of the relevant Tribunal Rules.[4]Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005 provides that where an individual has failed the instructional ability test three times the licence ceases to remain in force.[5]The Applicant failed their third attempt at the instructional ability test on 1 July 2026.[6]Legal Officer Haji made directions in this case on 3 July 2026 and these notified the Applicant that the Tribunal was considering striking out this case for the reasons set out above and provided that the Applicant had to the 17 July 2026 to either provide representations as to why it should not be struck out or confirmation of withdrawal of the Appeal.[7]The Applicant has made no submissions to challenge the strike out application nor have they confirmed the withdrawal.[8]In light of the above there is no reasonable prospect of the Applicant being able to successfully argue that the Tribunal has the power to grant a further period of trainee licence. .
