[1]The Appellant lodged an appeal on form GRC1, seeking an extension to his trainee licence[2]The Appellant was said to have failed his third attempt at his Part 3 assessment, and accordingly pursuant to Regulation 14(b) of the Motor Cars (Driving Instruction) Regulations 2005, is barred from further instruction.[3]The Respondent sought to strike out the appeal on the aforesaid basis, and the case was considered. Further Case Management Directions were made by Judge O’Connor. The Appellant was in short given until 22nd July 2025 to provide a basis upon which the Respondent’s position was incorrect.[4]No reply has been forthcoming from the Appellant. Rule 8(3) of the 2009 Tribunal Rules materially states:
“The Tribunal may strike out the whole or a part of the proceedings if … (c) the Tribunal considers there is no reasonable prospect of the appellant’s case, or part of it, succeeding.”
[5]Here the Appeal has no prospects of success. The Appellant has been given the chance to counter that argument, and has failed to do so. The Appeal is now entirely without merit and accordingly is struck out. Signed: HH Judge David Dixon Date: 4th August 2025
