Officers considered the reasonable expectations of individuals, taking into account: their expectations both at the time the information was collected and at the time of the request; the nature of the information itself; and the Data Protection principle of lawfulness, fairness, and transparency. Officers did consider the weight of legitimate public interest in disclosure against the rights of employees and, in this case, feel there is no overwhelming legitimate interest in releasing the details of the declarations and who made them. Officers are withholding all the details under Section 40(2) of the Freedom of Information Act, and in particular Section 40(3A), where disclosure of the information would breach one or more of the Data Protection principles.”
