‘Additional conditions to be satisfied for the grant of a licence 13.—(1) To the conditions as to which the Registrar is required to be satisfied for the grant of a licence under section 129 of the Act, there are added the following conditions which shall have effect subject to paragraph (3) below and to regulation 3(6). (2) The additional conditions are— … (d) that he has not failed the instructional ability and fitness test more than twice since he passed the written examination;’
‘I am writing to inform you that I will not be attending the hearing scheduled for today. As I have unfortunately failed my third attempt at the ADI Part 3 instructional ability test on26 June 2025 , I am no longer eligible to continue working as a trainee driving instructor. Regulation 14(b) of theMotor Cars (Driving Instruction) Regulations 2005 clearly states that a trainee licence remains in force until the day immediately following the trainee’s third unsuccessful attempt at the instructional ability test. As such, my trainee licence has now expired and all continuing rights under that licence have been revoked. Therefore, I believe my attendance at the hearing is no longer necessary or applicable.’
