“The Council has does not have any legal obligation to advise letting agents of changes to legislation or their obligations under it; that is a public expense which the Council has chosen to bear. The fact the Council took it upon themselves to do so, ensures all letting agents within the London Borough of Westminster have little, if any, excuse for any failure to comply with their obligations. This legislation is neither new nor novel. It as been in existence for over 5 years and over 4 years at the time of these breaches. Furthermore, even if the Appellant’s did not receive the information, as they assert, that does not abrogate them of their responsibility to ensure compliance with the legislation.”
