The Reach for Health Centre Ltd v The Pensions Regulator [2025] UKFTT 1213 (GRC)
[1]The Appellant lodged an appeal using the GRC1 form on 16 May 2025. The appeal was incomplete as the Appellant did not include a copy of the decision notice they sought to challenge.[2]By Directions and email dated 19 May 2025 the Appellant was required to provide a copy of the Decision Notice from the Regulator that it wished to challenge to the Tribunal within 28 days as it was not clear whether there was a right of appeal to the Tribunal. The Appellant did not comply with that Direction.[3]By Directions dated 11 September 2025 the Appellant was directed by 25 September 2025 to provide a completed copy of the “Pensions - Right to Appeal” form to the Tribunal.[4]The Appellant was directed to note that failure to comply with the Direction could lead to the Tribunal striking out the appeal for failure to comply without further direction.[5]In response to this, the Appellant provided details of payments made and payment arrangements but not a completed copy of the requested form. It remains unclear whether the Appellant has a right of appeal to the Tribunal.[6]The Appellant failed to comply with the Direction dated 11 September 2025 and accordingly there are grounds to strike out the appeal.
