“They have refused to provide a copy of the liability order they obtained circa November last year and have refused to indicate the exact date they applied to the magistrates court for the liability order and copies of the evidence they provided to the magistrate. Can you please ensure that if they are willing to provide all this to you by return so you can provide it to me by next Thursday then there is no need for me to apply for this under the FOI act. If they are not willing and or I do not get it by next Thursday please take this as a request for information under the FOI act.”
“5 ..at the root of this appeal is a single and relatively simple question. If the Information Commissioner states to a FOIA requester that she is not going to make a decision on his complaint because it is vexatious, does that complainant have the right of appeal to the First-tier Tribunal to challenge that refusal? 6. The short answer to that question is No.”
