“I can neither confirm nor deny if the MoJ holds the information that you have requested. Under sections 32(3) and 40(5) of the FOIA we are not obliged to confirm or deny whether we hold information that relates to court records and to do so would contravene any of the principles set out in Article 5(1) of the General Data Protection Regulation andsection 34(1) of the Data Protection Act 2018 .”
“27. The Appellant advances two grounds of challenge. Notably, no challenge is made in respect of the MoJ’s reliance on the s.12(2) exemption, and that substantive issue is therefore not considered further here.”
