I should point out that there is a requirement to identify the data controller both on your website and your emails. The website does not contain the required link to the privacy notice on the home page and the link provided in the email footnote doesn't work.”
‘ “environmental information” is: ‘any information in written, visual, aural, electronic or any other material form on – (a) the state of the elements of the environment, such as… water, soil, land, landscape… and the interaction among these elements; (b) factors, such as… waste… affecting or likely to affect the elements of the environment referred to in (a); (c) measures.. such as policies, legislation, plans, programmes, environmental agreements, and activities affecting or likely to affect the elements and factors referred to in (a) and (b) as well as measures or activities designed to protect those elements…’
‘(1) Subject to paragraph (3) and in accordance with paragraphs (2), (4), (5) and (6) and the remaining provisions of this Part and Part 3 of these Regulations, a public authority that holds environmental information shall make it available on request. … (3) To the extent that the information requested includes personal data of which the applicant is the data subject, paragraph (1) shall not apply to those personal data.’

‘(2) “Personal data” means any information relating to an identified or identifiable living individual… (3) “Identifiable living individual” means a living individual who can be identified, directly or indirectly, in particular by reference to— (a) an identifier such as a name, an identification number, location data or an online identifier, or (b) one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of the individual.’
‘(1) If on an appeal under section 57 the Tribunal considers - (a) that the notice against which the appeal is brought is not in accordance with the law, or (b) to the extent that the notice involved an exercise of discretion by the Commissioner, that he ought to have exercised his discretion differently, the Tribunal shall allow the appeal or substitute such other notice as could have been served by the Commissioner, and in any other case the Tribunal shall dismiss the appeal.
