“(1) Any provision in an agreement ... is void in so far as it purports; ... (b) to preclude a person from bringing any proceedings under this Act before an Employment Tribunal ... (2) Sub-section (1) does not apply to any agreement to refrain from instituting or continuing any proceedings ... if the conditions regulating compromise agreements under this Act are satisfied in relation to the agreement.”
“...s.203(2) of the ERA permits the parties to make valid compromise agreements but the word ‘ agreement’ must mean a valid agreement and the Employment Tribunal has to ensure that any purported compromise agreement is valid.”
