"Mental impairment" includes an impairment resulting from or consisting of a mental illness only if the illness is a clinically well-recognised illness. However, that provision was repealed, with effect from5 December 2005 , by theDisability Discrimination Act 2005 . In the result, therefore, there is now no statutory gloss on the meaning of "impairment", either generally or in the case of a mental illness. Sub-paras. (2) and (3) empower the Secretary of State to make regulations requiring "prescribed conditions" either to be or not to be treated as amounting to impairments.The Disability Discrimination (Meaning of Disability) Regulations 1996 were made under those powers and exclude various conditions, e.g. certain addictions and personality disorders.
