Under 3A: … a person discriminates against a disabled person if for a reason which relates to the … disability he treats him less favourably then he treats … others to whom that reason … does not apply and he cannot show that the treatment in question is justified. (2) Conduct shall be regarded as having the effect … only if, having regard to all the circumstances, including in particular the perception of the disabled person, it should reasonably be considered as having that effect."

When considering whether Mrs Lewis was constructively dismissed we must apply the test whether the respondent breached a fundamental term of the contract of employment; so that Mrs Lewis could regard the contract of employment as repudiated; and that she was no longer bound by it; and resigned because of that breach, and for no other reason; and did it expeditiously.
