"(4) In the absence of evidence establishing the contrary, a person shall be taken for the purposes of this paragraph to decide upon an omission -(a) when he does an act inconsistent with doing the omitted act…."
"15. There was no evidence one way or the other to establish that an omission was or was not decided upon. Paragraph 3(4) of Schedule 3 therefore applies. 16 If [the Appellant's] argument is that the act of offering cleaning work in the letter of April 2005 was "inconsistent with doing the omitted act" of taking reasonable steps to make adjustments, she is accepting that the date of the letter is the date on which the Respondents are "taken to decide upon an omission"
