"10 Mutuality of obligation and control are together the irreducible minimum legal requirements for the existence of a contract of employment. The Tribunal considered that the guidance of McKenna J in Ready Mixed Concrete (South East) Ltd v Minister of Pensions and National Insurance as approved by the House of Lords in Carmichael v National Power Plc should be followed by Tribunal.
