"Having done that, we were faced with the situation that Mrs Mills had been dismissed, and the Respondents had not entered a Notice of Appearance putting forward any reason for dismissal. Since they have not discharged the burden, placed on them bysection 98(1) of the Employments Rights Act 1996 , of showing the reason for dismissal, it follows that the dismissal is automatically unfair."

But Mrs Walker was present at the Tribunal and was assisting Mr Pearce, the manager of the business owned by her husband and herself, with the case. She had access to the documents in the Tribunal, and, the letters inferred, previously."
