[1]APPEARANCES For the Appellant MR R FREER (Solicitor) Messrs Pattinson & Brewer Solicitors 71 Kingsway London WC2B 6ST HER HONOUR JUDGE A WAKEFIELD This is an Ex Parte Preliminary Hearing of an appeal by Mrs Ketwaroo against the decision of an Employment Tribunal sitting at Watford by which, at an Interlocutory Hearing, she was ordered to pay within forty two days the costs of the Respondent in the sum of £750.00 plus VAT. This sum comprised in part the solicitors costs of the Respondent of work done prior to the interlocutory hearing and in part the fees of Counsel and the costs of the solicitor attending that hearing on behalf of the Respondent.[2]The grounds of the appeal are that the award of costs against the Appellant was perverse, in view of the fact that at the interlocutory hearing an application to strike out the originating application was in fact unsuccessful and, it is argued, the interlocutory hearing would have had to take place in any event regardless of any such application being due to be heard.[3]In all the circumstances and having regard to the arguments put forward to us today we consider that this matter should go forward to a full hearing. We put it in Category C. Time Estimate – 2 hours.
