"…our Client is prepared to agree to an order in the following terms: - 1 The Respondent consents to an order being made that the case be remitted to the original Tribunal for an oral hearing to take place to establish whether or not there should be a review. 2 If a review is granted it should follow on from that hearing. To assist the EAT we are of the view that the matter of whether or not a review should have been granted should have been listed for an oral hearing or a request for further information have been made by the Tribunal [that is, we take it, the Employment Tribunal]. We can therefore agree that it is just and equitable that the matter is remitted back to the Birmingham Tribunal upon the above basis."
