MISS S DELANEY v NORD ANGLIA INTERNATIONAL LTD [2002] UKEAT 1061_01_1802
[1]APPEARANCES For the Appellant THE APPELLANT NEITHER PRESENT NOR REPRESENTED MR RECORDER BURKE QC This was to be the Preliminary Hearing of Miss Delaney's appeal against the decision of an Employment Tribunal sitting in Manchester chaired by Mr Russell and sent to the parties with Extended Reasons on 31 July 2000. Miss Delaney has not appeared today to advance her appeal or to instruct the ELAAS Representative who was prepared to assist her if she so required.[2]There is in this case some history of non attendance in that Miss Delaney also did not appear on the occasion when she was seeking an extension of time for the presentation of this appeal. However, on that occasion she was contacted and asked this Tribunal to proceed on the papers.[3]Today there had been a message from Miss Delaney saying that she has had travel difficulties. This division of the Appeal Tribunal sitting today knows only too well that there have today been very extensive and substantial travelling difficulties which may have been beyond Miss Delaney's ability, either financial or otherwise, to cope with.[4]For that reason and that reason alone we think it is preferable simply to adjourn this hearing rather than to give a decision which might have to be subsequently the subject of a review. Accordingly this hearing is adjourned to a date which will of course be notified to Miss Delaney in the fullness of time.
