The Applicant informed the Tribunal that Mr Bastiampillai had brought proceedings against the same Respondents and his case had not yet been heard. It was the view of the Chairman that there was a risk that by giving evidence Mr Bastiampillai might prejudice his own case against the Respondent, bearing in mind that any findings of fact of the Tribunal which related to his employment would be binding on any subsequent Tribunal. In the circumstances the Applicant accepted the guidance given by the Chairman and Mr Bastiampillai was not called to give evidence."
