[1]APPEARANCES For the Appellants MR NICHOLAS UNDERHILL QC BBC Litigation Dept BBC White City 201 Wood Lane London W12 7TS For the Respondent HIS HONOUR JUDGE J R REID QC This is a Preliminary Hearing of an appeal by the Respondents below against a decision of an Employment Tribunal held at Shrewsbury, that decision having been sent to the parties and entered on the register on 30 July 2001.[2]The question is whether the Respondents discriminated against the Applicant below, Mr Kellewy, on the grounds of his national origins contrary to Section 1 of the Race Relations Act 1976 . The issues are clearly set out in the Notice of Appeal and in the skeleton argument for the Preliminary Hearing. It does not seem to me that it would assist anyone if I reiterated them in this interlocutory judgment.[3]It seems to us that this is a matter which should go to a Full Hearing. That does not mean that we are expressing any views whatsoever about the merits or otherwise of the appeal.
