[1]APPEARANCES For the Appellant MR S CRAMSIE (of Counsel) Appearing under the Employment Law Appeal Advice Scheme HIS HONOUR JUDGE D M LEVY QC In this Preliminary Appeal we have the advantage of hearing from Mr Cramsie of the ELAAS who identifies two grounds on which this appeal should go forward. The first is the fairness of the decision itself bearing in mind what happened to the comparator. The second is the analysis of the evidence which is found in the findings made by the Tribunal. We think both of these grounds are ones which are arguably right for appeal. We will allow this to go to a Full Hearing.[2]In the Appellant's Notice of Appeal he says that he has been to a 'legal doctor'. Now that he has had the benefit of professional legal advice we think it would be helpful if he has a professionally drafted Notice of Appeal. Mr Cramsie has undertaken to put in an amended Notice of Appeal within the next 7 days. Category C.
