MR A DAVIES T/A PLANET EARTH CHARTERED LANDSCAPE ARCHITECTS v MR S VERCAMMEN [2001] UKEAT 0567_01_2409
[1]APPEARANCES For the Appellant MR JOHN F LEWIS (Representative) 1 Cedar Hill Newport Isle of Wight PO30 1DN MR RECORDER LANGSTAFF QC In this Preliminary Hearing the central issue is whether or not compensation was properly calculated. It appears from the Employment Tribunal's Extended Reasons that the sum awarded was based upon the gross pay. The Appellant's point is that the employee's loss would have been the net pay and not the gross pay.[2]We think that is a point which justifies full argument. Because it is a short point we think that it will take no more than one hour to argue. It is Category C. We direct that skeleton arguments together with photocopies of any cases to be relied upon are provided no less than 14 days prior to the hearing. Further, bearing in mind the financial circumstances of this case, and therefore the possibility that the parties, once the Respondents have considered the nature of the appeal, may come to terms, we would ask that if that happens that for listing purposes the Registrar be informed as soon as possible.
