[1]APPEARANCES For the Appellant MR D.J.O'DEMPSEY (of Counsel) Instructed by: Edge & Ellison Rutland House 148 Edmund Street Birmingham B3 2JR HONOUR JUDGE WILCOX: We consider that it is arguable that the Tribunal in this case were in error by deciding that the process in the absence of the Appellant, having given leave to permit a substantial counter claim out of time where issues of dishonestly were raised and the Appellant had attended the first stage of hearing and given evidence.[2]We further consider that it is arguable that the Respondent erred in law is failing to grant a review having proceeded in the absence of the Appellant at the original hearing.[3]We consider that those limited grounds should be investigated at a full hearing at the EAT.[4]Category C - ½ day – skeleton arguments 14 days before the full hearing – full chronology.
