[1]APPEARANCES For the Appellant Mr D Hughes, husband of the Appellant MR JUSTICE HOLLAND: This matter has been listed before us this morning by way of a preliminary hearing. We are quite satisfied that the decision does give rise to a point of law that merits an inter-parties hearing.[2]The point of law emerges very clearly from the decision itself and it will be seen in paragraph 16 that the Tribunal itself was divided on the matter. The point is further developed, and well developed at that, by Mr Hughes on behalf of his wife in the grounds of appeal appended to the Notice of Appeal.[3]We need not presently develop the matter further, we are entirely satisfied that the appropriate order is an adjournment for that inter-parties hearing.[4]Turning to the directions, we would regard this a half day case, Category C and we direct that skeleton arguments be exchanged and served upon this Tribunal not later than 14 days before the hearing.
