MR M THORNE & MISS L ROLFE v THE RIVERSIDE CENTRE LTD [1999] UKEAT 1017_99_2311
[1]APPEARANCES For the Appellants NO APPEARANCE BY OR ON BEHALF OF THE APPELLANTS JUDGE PUGSLEY: This is a case in which the Tribunal received notice from the Employment Law Centre Ltd that they will not be attending and rely on written submissions. One matter, concerns us, it is asserted in the ground of appeal: - The Chairman did not allow either representative of the relevant parties to address the Tribunal panel on remedies. In all Tribunals we have attended we have never before witnessed a Tribunal Panel reach a decision regarding quantum without first hearing representations from the relevant parties".[2]Before this appeal is even considered we are of the unanimous view that the Chairman ought to comment on the suggestion that he did not allow either representatives of the relevant parties to address the panel on remedies. We have to say that this ought to take place before any other aspect of the matter is considered.[3]The case should be relisted once comments of the Chairman have been received.
