We have considered this matter carefully. We only have to be satisfied there is an arguable point of law. We do think there is an arguable point of law as to whether the Tribunal erred in holding that the promise which they found to be made by Mr Lodge on three or four occasions in May 1993, was not of binding effect. That is the point in this appeal and it is the only arguable point in the appeal. That is the matter that should proceed to a full hearing.
