MR JUSTICE WOOD (PRESIDENT): Mr Ithia appeared before an Industrial Tribunal on the 10th May 1991 at London (North) under the Chairmanship of Mrs Barbara Calvert QC. He was alleging racial discrimination under the provisions of the Race Relations Act 1976. On that occasion the Respondents were the Secretary of State for Employment, a Ms Fletcher and a Mr Chapman. During the process of hearing Mr Ithia indicated that he was not going on because he felt that the composition of the Tribunal, and indeed everyone appearing there was white, he was black, he felt he could not receive justice.In his Notice of Appeal to us at this Preliminary Hearing, he has repeated in the Notice of Appeal and in his letter to us that he really is complaining generally and overall about the racial imbalance on these occasions.We have read this carefully and we have decided that there is no error of law or point of law to be argued. This appeal must be dismissed even though Mr Ithia has not seen fit to attend today.
