"There was no dispute between the parties as to the relevant principles of law, which may be summarised as follows:
"The test for the Industrial Tribunal is not whether the Respondent committed the offence, but whether the Appellants reasonably believed after a reasonable investigation that they did."

"It is important to stress that what follows is really only an indication of different facets of this one issue. The employer must prove on the balance of probabilities -more likely than not - (i)that he believed - again on the balance of probabilities (not beyond reasonable doubt) - that the employee was guilty of the misconduct.
