DECISION
The Tribunal determines a rent of £617.50 per calendar month with effect from 29 November 2024. ____________________________________
REASONS
[1]The Landlord served a notice under Section 13(2) of the Housing Act 1988 (“the Act”) which proposed a new rent of £620.00 per calendar month (pcm), in place of the existing rent of £520.00 pcm, to take effect from 29 November 2024. The original tenancy commenced on 29 September 2017.[2]By an application received on 26 November 2024, under Section 13(4)(a) of the Act, the Tenant referred the Landlord’s notice proposing a new rent to the Tribunal for determination of a market rent. Inspection[3]The Tribunal has not carried out an inspection of the Property. Neither party requested an oral hearing. Accordingly, the Tribunal has considered this case on the basis of the papers provided by the parties and having regard to its own knowledge, expertise and online research. The Property[4]The application form combined with the Tribunal’s own research, confirmed essential details of the Property as a ground floor flat formed as a conversion, offering the following accommodation: Open living room, kitchen, raised mezzanine floor, box* bedroom and bathroom. Outside: Parking Space. The Property is situated within the small town of Shirebrook and there are amenities available within walking distance. Shirebrook lies approximately 20 miles to the north of Nottingham. * Tenant’s description. Evidence[5]Neither the Tenant nor the Landlord returned the Tribunal’s Reply forms. Determination and Valuation[6]Relying on its own expert, general knowledge of rental values in the area, the Tribunal considers that the majority of achieved rentals for flats with one bedroom in the locality of the subject appear to be in the range of £550.00 to £700.00 pcm. Considering the Property relative to the comparable information available, the Tribunal adopts £650.00 pcm as a starting point.[7]From this level of rent, the Tribunal has made adjustments in relation to the following: a) Tenant’s decorating liability at 5% of market rent. The full valuation is shown below: pcm Market Rent £650.00 Less a) Items given under a) above £30.00£32.50 Say £617.50 Decision[12]Therefore, the Tribunal determines the market rent at £617.50 with effect from 29 November 2024.
