“The Claimants are granted permission either (a) for Gavin Burrows to be treated as the Court’s witness and both parties may cross-examine him; (b) conduct examination-in-chief of Gavin Burrows when he is called to be cross-examined at trial by the Defendant as to the hearsay evidence relied upon by the Claimants; or (c) re-examine Gavin Burrows following cross-examination, with liberty to apply to treat him as a hostile witness pursuant to the Court’s power to control evidence set out inCPR 32.1 (b) and/or (c) and/orCPR 3.1 ”
