“.. the Claimant [was] seeking to make the Defendant personally liable to him for a trust that did not exist and had no basis in fact. The stakes for the Defendant were extremely high: he has been required to deal with these most serious allegations claimed to affect a very significant proportion of his assets for more than a decade. The Defendant was required to defend himself in a foreign court, in a foreign language and to answer accusations of giving false evidence. He should not have been put through the ordeal at all.”
“(i) written agreements which contain the terms on which a person has directly or indirectly contributed or agreed to contribute to the claimant’s costs in these proceedings; (ii) exchanges of correspondence which constitute an agreement containing the terms on which a person has directly or indirectly contributed or agreed to contribute to the claimant’s costs in these proceedings; and (iii) if a person has directly or indirectly contributed or agreed to contribute to the claimant’s costs in these proceedings pursuant to an oral agreement, documents evidencing the terms of that oral agreement.”
