“The permission granted in paragraph 1 of this Order applies to any such service as the Fourth Claimant may already have effected as at the date of this Order.”
“In these circumstances, the conjunction inCPR 71 of provision for oral examination of a personal judgment debtor (against whom an order may be obtained although he orshe is out of the jurisdiction) with provision for oral examination of officers of a corporate judgment debtor is not persuasive support for a proposition that an order may be made against the latter when he or she is out of the jurisdiction. There are basicdifferences between the two situations, and the presumption against extra-territorialityhas a potential application to the latter which it does not have to the former.”
