“I turn then to what at least to my mind is the central point in the case, which is whether or not Mr Caldwell has an arguable case. In this connection it is I think common ground, and consistent with what was said by Laddie J in paragraph 60 of his judgment in Thomas-Everard & Others v The Society of Lloyds, Lawtel (otherwise unreported as far as I am aware),18th July 2003 , that: “The court’s assessment of the seriousness of the challenge should [not] differ from one stage to the other.”
