“It is clear from the details supplied above that the financial position of the Group has improved since31 October 2016 , and that the Claimants would be able to meet any costs order which might be made against them within the proceedings without risking the viability or liquidity of the Group. Any costs order made would be paid in its entirety within a reasonable period of time, given that the vast majority of the resources are easily liquidated and realisable.”
“On an application of this kind the court is not concerned with legal rights and obligations but with a broad discretion which it will seek to exercise in a manner that will do justice. The only immutable principle is that the discretion must be exercised justly.”
